Your interview data including audio recordings, transcripts, summaries, AI-generated insights, and technical metadata is retained by Hyaa AI for a fixed period of 12 months from the date of your interview. After this period, it is automatically deleted or permanently anonymised.
7.2 Retention by the Employer
The Employer may retain copies of your data for a longer period if they export or download your interview results to their own systems. In those cases, the Employer is responsible for storing, securing, and deleting that data according to their own policies.
7.3 Legal Requirements
Some information may be retained for a longer period if required by law (for example, for security, auditing, or compliance obligations).
8. Your Rights as a Candidate
Depending on your location and applicable privacy laws, you may have the following rights regarding your interview data:
8.1 Right to Access
You may request a copy of the information collected during your interview, including transcripts and stored data.
8.2 Right to Correction
You may request correction of inaccurate Personal Data. (Please note that audio responses and transcripts generally cannot be edited once recorded.)

9.3 Approved Subprocessors
Certain trusted service providers (“Subprocessors”) assist with:

These providers only receive the minimum data necessary and are contractually required to protect it.
9.4 Exported Copies
If the Employer downloads or exports your interview data outside Hyaa AI, the Employer is responsible for securing and deleting those copies under their own policies.

Because Hyaa AI uses secure cloud infrastructure and trusted service providers, your interview data may be processed or stored in countries outside your own. These transfers are necessary to operate the interview platform.
10.1 Use of Global Service Providers
Your data may be processed by approved Subprocessors that provide:
hosting
storage
transcription
AI processing
communication services
Some of these providers operate in countries such as Australia, the United States, and the European Union.
10.2 Protection of Your Data
Whenever your data is transferred internationally, it is protected using legally recognised safeguards, such as:
Standard Contractual Clauses (SCCs) approved by the EU
UK Addendum or equivalent transfer agreements
strong encryption and access controls

10.3 No Unauthorised Sharing

You are not required to complete this AI interview. If you prefer an alternative interview method, you may contact the Employer to request one (if they offer alternatives).
11.2 Withdrawing Consent
You may stop the interview at any time before completion. You may also request deletion of your interview data after completion by contacting the Employer.
11.3 Effect of Withdrawal
If you withdraw your consent:
the Employer may not be able to continue evaluating your application using this interview
previously processed data may still be retained by the Employer if required for legal or operational reasons
Hyaa AI will stop further processing and will delete your data unless the Employer instructs otherwise in accordance with their obligations
Withdrawing consent does not affect any processing that has already occurred before your request.
12. Automated Decision-Making Statement

You may withdraw your consent at any time. Withdrawing consent will stop further processing but does not affect any processing already completed.
8.5 Right to Object to Automated Processing
You may request that AI-generated scoring or classifications not be used in decisions about your application. All hiring decisions are made by the Employer, not the AI.
8.6 Right to Lodge a Complaint
You may lodge a complaint with your local data protection authority if you believe your data has been processed unlawfully.
9. Who May Access Your Data
Your interview data is accessed only by parties who need it to conduct the hiring process or operate the interview platform.
9.1 The Employer
The Employer and its authorised hiring team members will have full access to your audio responses, transcripts, summaries, and any AI-generated insights or scoring. They use this information to review and manage your application.
9.2 Hyaa AI (Service Provider)
Hyaa AI may access your data only when necessary to:
operate the interview platform
process your responses
ensure service reliability and security
provide technical support if needed
Hyaa AI does not use your data for any purpose unrelated to the Employer’s interview.
9.3 Approved Subprocessors
Certain trusted service providers (“Subprocessors”) assist with:
storage
transcription
AI processing
hosting
workflow automation
communications
These providers only receive the minimum data necessary and are contractually required to protect it.
9.4 Exported Copies
If the Employer downloads or exports your interview data outside Hyaa AI, the Employer is responsible for securing and deleting those copies under their own policies.
10. International Data Transfers
Because Hyaa AI uses secure cloud infrastructure and trusted service providers, your interview data may be processed or stored in countries outside your own. These transfers are necessary to operate the interview platform.
10.1 Use of Global Service Providers
Your data may be processed by approved Subprocessors that provide:
hosting
storage
transcription
AI processing
communication services
Some of these providers operate in countries such as Australia, the United States, and the European Union.
10.2 Protection of Your Data
Whenever your data is transferred internationally, it is protected using legally recognised safeguards, such as:
Standard Contractual Clauses (SCCs) approved by the EU
UK Addendum or equivalent transfer agreements
strong encryption and access controls
contractual obligations requiring providers to protect your data
10.3 No Unauthorised Sharing
Your data will never be sold, shared with advertisers, or used for unrelated purposes.
10.4 Controller Responsibility
The Employer remains responsible for ensuring that any international transfers made on their behalf comply with the laws in their region.
11. Voluntary Participation & Withdrawal of Consent
Your participation in this interview is entirely voluntary. You may choose whether to continue, and you may withdraw your consent at any time.
11.1 Voluntary Participation
You are not required to complete this AI interview. If you prefer an alternative interview method, you may contact the Employer to request one (if they offer alternatives).
11.2 Withdrawing Consent
You may stop the interview at any time before completion. You may also request deletion of your interview data after completion by contacting the Employer.
11.3 Effect of Withdrawal
If you withdraw your consent:
the Employer may not be able to continue evaluating your application using this interview
previously processed data may still be retained by the Employer if required for legal or operational reasons
Hyaa AI will stop further processing and will delete your data unless the Employer instructs otherwise in accordance with their obligations
Withdrawing consent does not affect any processing that has already occurred before your request.
12. Automated Decision-Making Statement
This interview uses AI to assist with the analysis of your responses, but it does not make hiring decisions.
12.1 No Automated Hiring Decisions
AI-generated summaries, classifications, or scoring are provided only as supportive information. All hiring decisions including screening, shortlisting, or rejection, are made by the Employer’s human hiring team.
12.2 Human Review
Your interview data is always reviewed by authorised personnel at the Employer. The AI cannot approve, deny, or rank candidates on its own.
12.3 Right to Contest Automated Outputs
If you disagree with any AI-generated insights or scoring, you may contact the Employer and request that your application be reviewed manually.
